Joel Rabin Plans to Sue the BDA

Recent candidate for the Bartlesville City Council, Joel Rabin has sent notifications that he intends to sue the Bartlesville Development Authority, GBT Realty, and Bartlesville Investment Partners, LLC in Federal court for alleged violations of the Clean Water Act.  Rabin claimis to have sent the appropriate ntofications to the parties he plans to sue under the legal letterhead of The Indian and Environmental Law Group.

Rabin claims that the Silverlake Village development that is being built on Adams Blvd adversely impacts the waters that he fishes in.  He claims that because the development lies in the 100-year flood plain, the work being done to bring the shopping center up to the same level as the Lowe's store adversely affecte the wetlands and streams in the area. 

Rabin's document claims the waters flowing through Bartlesville are, themselves, directly connected to interstate commerce. It goes on to say there are numerous tributaries of the Caney River which pass through or originate within Bartlesville and the actions of individuals and public and private entities have a significant impact on these tributaries.

According to the filing, Rabin intends to bring appropriate actions to prevent the fill on behalf of, 1) Bartlesville Development Authority, 2) GBT Realty Corporation, or 3) Bartlesville Investment  Partners,  L.L.C.
